Yes this does happen. So the answer is:

<jsp:output omit-xml-declaration="yes" />

<jsp:directive.page
pageEncoding="ISO-8859-1"
contentType="text/html; ISO-8859-1" />

This intructs the jspx file ( an XML file ) to tell your browser it
has to be rendered as text/html.
Sets the Content-type: header (see firebug to compare the values of
the Response header before and after if you are interested.
